1. Age Requirement

You must be at least 18 years old to shop on Herbz.dk.

By completing a purchase, the customer confirms that they are at least 18 years old.

Products purchased from Herbz must be kept out of reach of persons under the age of 18.

Herbz reserves the right to cancel an order if there is reasonable suspicion that the customer does not meet the age requirement.

2. Products, Product Names and Use

Product names on Herbz.dk may be trade names or fictional designations used for identification and marketing purposes.

Where a product consists of or is based on hemp, the relevant product specifications will be stated in the individual product description.

Designations, product names, images or descriptions must not be understood as an indication that a product is identical to or should be equated with illegal cannabis.

The customer is responsible for using and storing the products in accordance with the product declaration, intended use and applicable law.

Herbz cannot be held liable for damage or loss resulting from illegal, irresponsible or other use contrary to the product’s stated purpose, to the extent such limitation of liability is permitted under applicable law.

3. CBD, Cannabinoids and Medical Use

Products derived from the cannabis and hemp plant may be subject to different regulatory frameworks depending, among other things, on the product’s contents, composition, intended use and marketing.

Unless expressly stated otherwise, Herbz products are not marketed as medicinal products and are not intended to diagnose, treat, alleviate, cure or prevent disease.

Information provided on Herbz.dk must not be regarded as medical advice.

Customers should seek relevant professional advice if they are uncertain about the use of a product.

4. Prices

All prices on Herbz.dk are stated including VAT unless expressly stated otherwise.

The currency applicable to the specific order is shown on the webshop and at checkout.

Any shipping costs and other charges will be displayed before the order is finally completed.

Herbz reserves the right to correct obvious pricing errors, typographical errors and technical errors.

If a price is clearly incorrect, Herbz reserves the right to cancel the order. If payment has already been completed, the amount paid will be refunded.

5. Discounts and Discount Codes

Discounts, campaigns, coupons and discount codes cannot generally be combined with other offers or discounts unless expressly stated otherwise.

Herbz may set specific conditions for individual campaigns or discount codes, including minimum purchase requirements, validity periods and which products are included.

6. Payment

Herbz accepts payment through the payment methods displayed at checkout, including, where available:

  • Dankort

  • Visa/Dankort

  • Visa

  • Mastercard

  • MobilePay

  • Visa Electron

Payment for physical goods will generally only be charged when the goods are dispatched, unless otherwise permitted or agreed under applicable law.

When paying with a debit card, the amount may be reserved in the customer’s account in accordance with the card issuer’s terms until the payment is completed or the reservation is released.

Delivery

7. Delivery Areas

Herbz delivers to Denmark and a number of other European countries.

We deliver, among other places, to:

  • Denmark

  • France

  • Germany

  • Sweden

  • Spain

  • Italy

Herbz may also offer delivery to additional countries.

The countries to which Herbz currently offers delivery are shown among the available delivery options at checkout.

Delivery areas may change from time to time, including as a result of shipping conditions, local laws or regulatory considerations.

The fact that a country can be selected as a delivery destination at checkout does not in itself constitute a guarantee that every product on Herbz.dk may legally be imported, possessed or used in that country.

For deliveries outside Denmark, the provisions on international delivery, import and local legislation below apply.

8. Delivery Time

For deliveries within Denmark, the expected delivery time is normally 1–3 business days, unless otherwise stated at the time of ordering.

Orders placed before 1:00 PM are generally intended to be dispatched the same business day.

This is not a guarantee of same-day dispatch unless expressly agreed otherwise.

For deliveries to other countries, delivery times may be longer.

The expected delivery time depends, among other things, on the destination country, chosen delivery method, carrier and any customs or authority processing.

Current delivery options, estimated delivery times and shipping prices are shown at checkout where this information is available.

Once the shipment has been dispatched, the customer will normally receive a Track & Trace number where this is offered by the carrier.

Shipping Prices in Denmark

Bring – Parcel Shop

  • Free for purchases over DKK 499

  • Otherwise DKK 49

Bring – Home Delivery

  • Free for purchases over DKK 499

  • Otherwise DKK 59

For deliveries outside Denmark, the current shipping price will be shown at checkout.

The shipping prices and delivery options displayed at checkout apply to the specific order.

9. Delivery Delays

Stated delivery times are indicative unless a specific delivery date has been expressly agreed.

Delays may occur as a result of circumstances involving the carrier, unusually high order volumes, weather conditions, customs processing, authority inspections or other circumstances outside Herbz’s direct control.

The customer’s rights in the event of delay are governed at all times by applicable mandatory law.

10. Uncollected Parcels

Failure to collect a parcel does not in itself constitute exercise of the right of withdrawal.

If the customer wishes to withdraw from the purchase, the customer must provide Herbz with a clear notice to that effect.

If a parcel is returned to Herbz due to failure to collect it, an incorrect address provided by the customer or other circumstances for which the customer is responsible, Herbz may charge documented additional shipping and return costs to the extent permitted by applicable law.

International Delivery, Import and Local Legislation

11. Legality of Products Outside Denmark

Herbz offers its products on the basis of the legislation applicable in Denmark at the time of sale.

Rules concerning cannabinoids, hemp, CBD and related products vary significantly from country to country and may change over time.

A product that may lawfully be sold in Denmark is therefore not necessarily lawful to import, possess, use, market or resell in another country.

Herbz does not provide any guarantee that a product complies with the legislation of the customer’s destination country unless this has been expressly confirmed in writing by Herbz.

The fact that Herbz offers shipping to a particular country must not be understood as an individual legal assessment or guarantee of the legality of each individual product in that country.

12. Customer Responsibility for International Delivery

When placing an order for delivery outside Denmark, the customer is responsible for checking the rules applicable in the destination country before placing the order.

The customer must, among other things, investigate and ensure:

  • that the ordered products may lawfully be imported into the destination country,

  • that the products may lawfully be possessed and used,

  • that any national, regional and local rules are complied with,

  • that any age requirements and product or quantity restrictions are complied with,

  • that any requirements for permits, registrations, licences or authority approvals are fulfilled.

By completing the order, the customer confirms that they have, to the best of their ability, investigated the relevant rules.

Nothing in this section limits the customer’s rights under mandatory law.

13. Customs, Taxes and Import Charges

Unless otherwise stated at checkout, the customer is responsible for any:

  • customs duties,

  • import VAT,

  • import charges,

  • administration fees,

  • customs clearance fees,

  • other public charges,

that may be imposed in connection with import into the destination country.

The customer is also responsible for complying with any lawful requirements imposed by customs authorities, carriers or other public authorities, including requirements to provide documentation.

If Herbz is required under applicable law to collect or remit a specific tax or charge, that obligation takes precedence over the above.

14. Customs Inspections and Authority Intervention

International shipments may be subject to customs inspections, random inspections or other authority processing.

Herbz cannot guarantee that an international shipment will not be delayed, inspected or detained by authorities in the destination or transit country.

To the extent permitted by applicable mandatory law, Herbz is not liable for loss or costs arising solely from:

  • detention by customs authorities,

  • seizure or confiscation as a result of local legislation,

  • refusal of import,

  • destruction of products ordered by public authorities,

  • delays resulting from authority inspections,

  • fines, fees or other sanctions imposed on the customer as a result of the customer’s failure to comply with local law.

Herbz’s liability is not limited where liability follows from mandatory law or arises from circumstances for which Herbz is responsible under applicable law.

15. Risk of Loss

For consumer purchases, the risk of loss passes to the customer at the time determined by applicable law.

As a general rule, Herbz therefore bears the risk of the goods during ordinary delivery to the customer until the goods have been delivered in accordance with applicable rules.

This provision does not limit the customer’s mandatory consumer rights.

16. Non-Delivery Due to Import Restrictions

If an international shipment cannot be delivered due to an import prohibition, local product restrictions or a decision by a public authority in the destination country, Herbz will assess the matter on a case-by-case basis in accordance with applicable law.

If the failure to deliver is solely due to circumstances for which the customer is responsible under these terms and conditions and applicable law, Herbz is not obliged to provide a refund, replacement delivery or other compensation beyond what follows from mandatory law.

If the goods are returned to Herbz, any refund may be reduced by documented costs to the extent permitted by applicable law.

17. Right to Refuse International Orders

Herbz reserves the right to refuse or cancel an order before dispatch where there is a legitimate reason to do so.

This may include, among other things, situations where:

  • Herbz has reason to believe that the product cannot lawfully be shipped to the destination country,

  • specific product or import restrictions apply,

  • regulatory requirements make delivery disproportionately difficult,

  • the information provided in the order is incomplete or obviously incorrect,

  • there is reasonable suspicion of misuse, fraud or violation of applicable law.

Herbz may also choose to restrict certain products from delivery to specific countries even where other products may still be ordered to that country.

If Herbz cancels an already paid order before dispatch, the amount paid will be refunded unless otherwise provided by applicable law.

Laboratory Analyses and Cannabinoid Content

18. Laboratory Analyses

Herbz uses laboratory analyses as part of the quality control process for relevant products.

Laboratory results and certificates of analysis generally relate to the tested sample and the relevant batch or production lot.

A published laboratory result therefore does not constitute a guarantee that every individual unit or every part of the product contains exactly the same concentration as the tested sample.

19. Natural Variation and Batch Variation

Natural and production-related variations in cannabinoid content may occur.

Variations may occur, among other things:

  • between different production batches,

  • between different parts of the same product,

  • between the tested sample and the individual product,

  • as a result of the laboratory analysis method,

  • as a result of measurement uncertainty and sampling.

Such variations must be assessed in relation to the specific product, product declaration and applicable law.

20. Analysis Method and Sampling

Laboratory analyses are performed on selected samples and do not necessarily constitute an individual analysis of every product sold.

For products to which a specific cannabinoid has been added, the cannabinoid may be distributed with a certain degree of natural or technical variation.

A small sample may therefore show a concentration that differs from the average concentration of the product as a whole.

21. Infused Products

For infused products, the product declaration states the amount or concentration of the relevant cannabinoid that, according to the production specification, has been added to the product.

A laboratory analysis of a sample may differ from this value as a result of, among other things:

  • distribution within the product,

  • sampling,

  • the analysis method,

  • the laboratory’s measurement uncertainty,

  • natural or technical variations.

The value stated on the product declaration should therefore be understood as the product’s declared production specification and not as a guarantee that every isolated sample will produce exactly the same analytical result.

22. Batches and Certificates of Analysis

Herbz may update laboratory analyses, production methods and product specifications from time to time.

If a product is sold in multiple batches, a published certificate of analysis may relate to a specific batch.

Where a batch number appears on the product or certificate of analysis, this should be used to identify the relevant analysis.

Nothing in this section limits the customer’s rights where the product is defective under applicable mandatory law.

Right of Withdrawal and Returns

23. 14-Day Right of Withdrawal

As a consumer, you generally have a 14-day right of withdrawal when purchasing from Herbz.dk.

The withdrawal period expires 14 days after the day on which you, or a third party appointed by you other than the carrier, physically receive the goods.

If an order contains multiple items delivered separately, the period will generally run from receipt of the final item.

If you wish to exercise your right of withdrawal, you must provide Herbz with a clear statement of your decision to withdraw from the purchase before the expiry of the withdrawal period.

The notice may be sent to:

mail@herbz.dk

You may also use the standard withdrawal form at the bottom of these terms and conditions.

Simply refusing to accept or collect the parcel is not sufficient.

24. Returns Following Withdrawal

Once you have informed Herbz that you wish to withdraw from the purchase, the goods must be returned without undue delay and no later than 14 days after you notified us of your decision.

Returns must be sent to:

W-Shop
Midtager 29
2605 Brøndby
Denmark

We only accept parcels sent directly to the return address unless otherwise agreed in advance.

Cash-on-delivery parcels are not accepted.

The customer is generally responsible for the direct costs of returning the goods unless otherwise agreed or required by applicable law.

This also applies to returns from outside Denmark.

Any international return postage, customs or handling charges are borne by the customer to the extent permitted by applicable law.

The customer bears the risk of the goods during the return shipment.

25. Condition of Returned Goods

The customer is only liable for any reduction in value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

If the goods have been handled or used beyond this extent, Herbz may make a deduction corresponding to the documented reduction in value to the extent permitted by applicable law.

26. Refunds Following Withdrawal

If you exercise your right of withdrawal, Herbz will generally refund all payments received from you in relation to the withdrawn purchase.

This includes standard delivery costs, but not additional costs resulting from your choice of a more expensive delivery method than the least expensive standard delivery option offered by Herbz.

The refund will be made without undue delay and no later than 14 days after the day on which Herbz received your notice of withdrawal.

Herbz may withhold the refund until the goods have been returned, or until the customer has provided evidence that the goods have been sent back, whichever occurs first.

The refund will generally be made using the same payment method used for the original transaction unless expressly agreed otherwise.

Complaints and Defective Goods

27. Complaints Concerning Defects

For consumer purchases, the mandatory rules concerning defects that apply to the specific agreement shall apply.

For Danish consumers, a 2-year right to complain about defects generally applies from the date of delivery under the Danish Sale of Goods Act.

For consumers in other countries, additional or different mandatory rights may apply under the law governing the purchase.

The right to complain covers defects for which Herbz is responsible under applicable law.

If the goods are defective, the customer may, depending on the applicable rules, be entitled to:

  • repair,

  • replacement,

  • a proportionate price reduction,

  • termination of the purchase.

The customer must submit a complaint within the time limits prescribed by applicable law.

Complaints may be sent to:

mail@herbz.dk

Please describe the issue in as much detail as possible and include relevant photographs, the order number and other supporting documentation.

If the complaint is justified, Herbz will cover the necessary and reasonable costs associated with handling the complaint in accordance with applicable law.

Complaints Procedure

28. Complaints to Herbz

If you wish to complain about a product or service, please first contact Herbz at:

mail@herbz.dk

Please include the order number, product and a description of the issue.

29. Danish Consumer Complaints System

If a solution cannot be reached directly with Herbz, a consumer may, where the applicable conditions are met, submit a complaint through the Danish consumer complaints system.

The complaint will generally first be handled by:

The Mediation Team for Consumer Complaints
Nævnenes Hus
Toldboden 2
8800 Viborg
Denmark

Complaints may be submitted via the complaints portal operated by Nævnenes Hus.

If the matter is not resolved through mediation, it may, under the applicable rules, in certain cases proceed to the Danish Consumer Complaints Board.

The applicable minimum claim amounts, fees and other conditions are available on the website of Nævnenes Hus.

Consumers residing in another EU country may also seek guidance on cross-border consumer complaints through the relevant European consumer organisations.
